Availability of Facilities and Equipment for Resource Utilization *
(Please be advised that approval may be denied under Article 17 of the Enforcement Decree of the ACT ON SECURING, MANAGEMENT, AND USE OF MARINE FISHERY BIO-RESOURCES if the applicant does not possess the necessary facilities and equipment required for utilizing the marine fishery bio-resources.)
Grounds for Limiting Approval of Marine Biological Resource Distribution
In accordance with Article 20, Paragraph 2 of the ACT ON SECURING, MANAGEMENT, AND USE OF MARINE FISHERY BIO-RESOURCES, the Ministry of Oceans and Fisheries may deny distribution approval in any of the following cases:
1. Where the quantity of marine fishery bio-resources secured and managed falls short of the standards prescribed in paragraph (4);
2. Where it is intended to be used for any purpose other than testing, research, or education;
3. Where overseas allotment is prohibited by any other statutes or regulations;
4. Where it is deemed that overseas allotment is likely to cause damage to the State.
Consent Form for the Distribution of Marine Biological Resources
1. Distributed marine biological resources must be used solely for research purposes, including testing, material development, and education.
2. Recipients must respond to inquiries regarding the use of the distributed resources.
3. For patent applications or commercial use, recipients must seek a separate agreement with the National Marine Biodiversity Institute of Korea (MABIK).
4. Publications using the distributed resources must acknowledge MABIK in the Materials and Methods section or acknowledgments. A copy of the published paper (reprint, copy, or digital file) should be sent to MABIK, indicating MABIK’s English name, abbreviation, or resource number.
5. The resources may not be provided, transferred, or sold to third parties.
6. MABIK and the resource depositor are not liable for the receipt, management, preservation, or use of the resources.
7. For unspecified matters, consult with MABIK and the relevant depository institution.
